The E visa category is designed for nationals of countries with which the U.S. maintains a treaty of commerce and trade. The main types are the E-1 (Treaty Trader) and E-2 (Treaty Investor), with the E-3 designated specifically for Australian professionals in specialty occupations.
The E-1 visa is for individuals or companies engaging in constant international trade between the U.S. and the treaty country. There is a list of over 70 countries so please check out the list to see if your country exists there. Does your company trade with the USA? Do you import or export mainly all your services or products between your country and the US? If so you have a good chance to apply for an E1 for you and all your staff.
The E-2 visa is for financial investors who have invested money into a US business. This can be your own business that you are starting to set up or an existing business. Many times the investor will set up the business from scratch, but the consular officer will want to ensure that this business is genuine and operating and not just an idea.
The E-3 visa is solely for Australian citizens who have a job offer for a US company and the position requires a degree and remains uncapped annually and has similar requirements to H-1B but with faster processing and fewer restrictions.
The TN visa is available exclusively to citizens of Canada and Mexico under the U.S.-Mexico-Canada Agreement (USMCA), formerly NAFTA. It allows qualified professionals to work in the U.S. temporarily in pre-approved occupations accompanied with a Job offer.
